In the case registered under file number 2017/1001 at our court, the defendant, Ahmet Arif Göncü, in his petition dated 09/03/2023, asserted that the judgment rendered by our court failed to specify the independent section number of the immovable property subject to the dispute. Upon this submission, the court reviewed the matter ex officio. Following the review it was determined that the immovable property in question was identified in the statement of claim as Independent Unit No. 1, on the 1st Floor, Parcel No. 11, Plot No. 142, located in Saray District. However, the judgment rendered by our court on 01/09/2020 stated the following: “The co-ownership of the immovable property registered in Plot No. 142, Parcel No, 11, located in Saray District, Anamur County, Mersin Province, shall be dissolved by public auction.” Within this regard, the case file was re-exemined by our court in accordance with Article 304 of the Turkish Code of Civil Procedure (HMK) ex officio.
On account of the previous notifications sent to the defendant, HASAN ALI GÖNCÜ (Turkish ID No. 42055440172), at his registered domestic and international addresses in the national judiciary informatics system (UYAP) were returned undelivered, the court has hereby resolved to notify the request for correction of the judgment, the procedural decision, and the hearing date by way of public announcement, as stipulated under Article 304 of HMK.
Pursuant to Article 317 of HMK, you are hereby warned and issued as follows: You shall submit your preliminary objections regarding the request for correction of the judgment within a non-extendable period of two weeks. Provided you fail to submit your objections within this period, you will be barred from raising any future objections. You are required to attend the hearing at the specified date and time. You are advised to prepare for a potential) settlement if applicable. Failure to attend the hearing will prevent you from objecting to proceedings conducted in your absence.
