By James Pogue. NEW YORK – As Americans, we are proud of our freedom, even touting it as a badge of honor but what happened to a woman in the small town of Trinidad, Texas is a lesson for everyone. Jennifer Combs was arrested on May 8, 2026 after warning residents about dangerous bacteria in her city’s water supply on her “Southern Belle Watch” Facebook page to encourage citizens to report complaints about the water to state regulators. In fact, there had been numerous citizen complaints of “brown, sewer-colored tap water. Jennifer posted a warning, stating: “We have received reports that some citizens have been hospitalized due to bacteria in the water. This is a serious public health concern that deserves immediate attention.”
Instead of praising her warning, Jennifer Combs was ordered to be arrested by Trinidad Police Chief Charles Gregory, claiming the case was “cut and dry” due to what Gregory claimed were no confirmed bacterial hospitalizations. Meanwhile, police alleged her post constituted a felony because it spread false information, capable of inciting public panic. The result was that Combs was handcuffed in her front yard, spending 23 hours in jail before the charges were dropped by a municipal judge and a grand jury in her country refused to indict her.
It turns out that police officers withheld crucial facts. Officers left out the massive volume of legitimate citizen water complaints and the context of Comb’s watchdog page to mislead the court into granting the warrant for Combs arrest. After all her charges were dropped, Combs filed a federal civil rights lawsuit against the City of Trinidad, the police chief and a city council member, alleging targeted political retaliation to silence criticism of the town’s failing infrastructure. The Texas Commission on Environmental Quality (TCEQ) and the Texas Rangers began formal investigations into the city’s water infrastructure and government actions.
The point is that the backlash from experts on the American Constitution and legal advocates was tremendous, criticizing the arrest. Under the First Amendment, citizens are broadly protected when discussing matters of intense public concern, like the safety of municipal drinking water. A prominent legal professor said the American government has no right to criminalize even inaccurate speech, unless it meets a strict threshold of intentional, malicious fraud, designed to cause an immediate catastrophe. This heinous situation should serve as a warning to all citizens currently living under an administration that promotes and encourages limiting freedom of speech in the U.S. especially on social media platforms.
McCarthyism has reared its ugly head in 2026 when a legitimate concern voiced on Facebook is a reason to arrest an innocent, concerned citizen. In the meantime, there are numerous violent, terroristic posts on social media platforms including Facebook that should be taken down – what is Meta and the U.S. government doing about those? Freedom of speech in America is a birthright with the caveat that we don’t mean speech that leads to mass shootings, racist acts of violence and terrorism.
